Custom Jewelry Design & CAD Deposit Agreement

By purchasing the $300 Custom Jewelry Design & CAD Deposit, you are commissioning KB&CO to begin custom design services for your jewelry and agree to the following terms.

Please review these terms carefully before submitting payment.

1. $300 Custom Design & CAD Deposit

A $300 non-refundable deposit is required before KB&CO begins CAD design work for a custom jewelry order.

The $300 deposit is non-refundable immediately upon payment.

The deposit compensates KB&CO for beginning the custom design process, consultation, project administration, CAD preparation, and allocation of design resources.

However, when the customer completes the custom jewelry purchase within the applicable timeframe, the original $300 deposit will be credited in full toward the final purchase price of the jewelry.

For example, if the agreed final price of your custom piece is $5,000, the original $300 deposit will be applied toward that purchase price, leaving a remaining balance of $4,700.

The deposit is not refundable if the customer changes their mind, abandons the project, fails to respond, fails to approve the design, or fails to complete the purchase within the applicable timeframe, except where otherwise required by law.

2. Initial CAD Delivery

After receiving the $300 deposit and the information reasonably necessary to begin the design, KB&CO will generally provide the customer's initial CAD rendering within a few business days.

This timeframe is an estimate and may vary depending on design complexity, workload, requested specifications, communication delays, or other circumstances.

The CAD will be delivered using the communication method being used for the project, which may include email, text message, social media messaging, or another agreed method.

3. 30-Day Custom Order Period

The customer's 30-calendar-day custom order period begins on the date KB&CO delivers the first CAD rendering.

During this 30-day period, the customer must review the design, request any permitted adjustments, provide final approval, and pay the remaining balance of the custom jewelry order in full.

Final CAD approval alone does not satisfy the 30-day requirement.

The remaining balance must also be paid in full within the 30-calendar-day period unless KB&CO expressly agrees otherwise in writing.

4. Minor CAD Adjustments

The initial $300 CAD deposit includes reasonable minor adjustments to the original design concept during the active 30-day period.

Minor adjustments may include reasonable modifications to details such as proportions, stone placement, lettering, dimensions, or similar elements of the originally requested design.

The initial CAD fee does not include unlimited redesigns or an entirely new design concept.

Major design changes, substantially different concepts, or requests requiring the design process to be restarted may require an additional design/CAD fee at KB&CO's discretion.

KB&CO will notify the customer before charging an additional fee for substantial redesign work.

5. Expiration After 30 Days

If the remaining balance has not been paid in full within 30 calendar days after delivery of the first CAD, the active custom-design period expires.

The original $300 deposit remains non-refundable.

The customer does not lose the ability to pursue the project permanently. However, continuing or reopening the custom project after expiration requires payment of an additional $300 CAD/reactivation fee.

Payment of the additional fee allows KB&CO to reopen the project, subject to current pricing, material availability, stone availability, and production availability.

The original $300 deposit is not refunded because the project expired.

6. Additional $300 Reactivation Fee

If a project expires after the initial 30-day period, an additional $300 non-refundable CAD/reactivation fee is required before KB&CO resumes work.

Unless KB&CO states otherwise in writing, this additional $300 fee is a reactivation/design fee and is not an additional credit toward the final jewelry purchase price.

Only the original $300 Custom Jewelry Design & CAD Deposit is credited toward the originally quoted final purchase price, subject to completion of the order under these terms.

KB&CO may waive or modify a reactivation fee at its discretion, but any exception must be confirmed in writing.

7. Pricing After Expiration

Quotes associated with a custom jewelry project are based on pricing, materials, stones, precious-metal markets, manufacturing costs, and availability existing during the active project period.

If a project expires, KB&CO does not guarantee that the original quoted price will remain available.

Before an expired project is resumed, KB&CO may update the price to reflect current diamond or gemstone availability, precious-metal pricing, manufacturing costs, material costs, or other changes affecting the order.

The customer will be informed of any revised price before being required to complete the purchase.

8. CAD Renderings

CAD renderings are digital representations used to design and communicate the proposed appearance of custom jewelry.

CAD renderings are not photographs of the finished physical jewelry.

The finished piece may appear somewhat different because of polishing, stone setting, manufacturing tolerances, lighting, reflections, metal finishing, stone characteristics, photography, and the inherent differences between digital renderings and physical jewelry.

9. Customer Responsibility

Customers are responsible for providing and reviewing accurate information, including, where applicable:

  • Ring or jewelry size

  • Names and spelling

  • Dates

  • Numbers

  • Initials

  • Logos and symbols

  • Metal selection

  • Stone preferences

  • Dimensions

  • Engraving

  • Reference images

  • Other personalization or specifications

The customer is responsible for carefully reviewing these details before approving the final CAD.

10. Final CAD Approval

When the customer approves the final CAD or design, the customer confirms that the design and specifications are acceptable and authorizes KB&CO to proceed toward manufacturing once applicable payment requirements have been satisfied.

Customers should carefully inspect spelling, sizing, proportions, stone placement, personalization, and other visible design details before approving the CAD.

Once manufacturing begins, changes may no longer be possible.

If a requested post-approval change can be accommodated, additional design, material, labor, stone, or manufacturing charges may apply.

11. Final Payment

The remaining balance must be paid in full before production unless KB&CO expressly agrees to different payment terms in writing.

Payment of the original $300 deposit does not obligate KB&CO to manufacture or release the finished jewelry without receiving the required remaining balance.

Once the remaining balance has been paid and production has begun, the order is subject to KB&CO's custom-order and final-sale provisions.

12. Custom Orders Are Final Sale

Custom jewelry is manufactured specifically for the individual customer.

Once final approval, payment, sourcing, manufacturing, casting, stone setting, engraving, sizing, or other production has begun, the custom order is final sale and not eligible for return, exchange, or refund, except where otherwise required by applicable law or expressly agreed to by KB&CO in writing.

13. Diamonds & Gemstones

Stone availability can change throughout the design process.

Unless a particular diamond or gemstone has been specifically reserved or purchased for the customer, KB&CO cannot guarantee that a previously discussed or displayed stone will remain available.

If a project expires, previously offered stones may no longer be available when the project is reactivated.

Where an independently graded diamond or gemstone is selected, the applicable grading report governs the characteristics graded by that laboratory.

14. Production Timeline

Production begins after the applicable design approval, final payment, and other requirements have been completed.

Production and delivery timelines are estimates unless KB&CO expressly guarantees a specific date in writing.

Custom jewelry production may be affected by stone sourcing, casting, setting, manufacturing, quality control, shipping, holidays, material availability, and other circumstances outside KB&CO's reasonable control.

15. Customer Communication

Customers are responsible for remaining reasonably available during the custom-design process.

Failure to respond to KB&CO, review CAD renderings, request revisions, approve a design, or provide required information does not pause the 30-day period.

The 30-day period continues from the date the initial CAD is delivered unless KB&CO expressly grants an extension in writing.

16. Intellectual Property & CAD Files

Unless otherwise agreed in writing, CAD files, manufacturing files, renderings, technical drawings, and other design materials created by or for KB&CO remain the property of KBCOJEWELRY LLC or its applicable designer or manufacturer.

Payment of a CAD deposit commissions design services but does not transfer ownership of the underlying CAD or manufacturing files.

Customers may not reproduce, manufacture from, distribute, sell, or provide KB&CO's CAD/manufacturing files to another jeweler or manufacturer without written authorization.

17. Customer-Submitted Intellectual Property

Customers requesting designs incorporating logos, artwork, trademarks, characters, photographs, or other third-party intellectual property represent that they possess the necessary rights or permission to request its use.

KB&CO reserves the right to decline a design request involving intellectual property that KB&CO reasonably believes may be unauthorized.

18. Chargebacks & Payment Disputes

Purchasing the $300 Custom Jewelry Design & CAD Deposit constitutes authorization for KB&CO to begin custom-design services and acknowledgment that the deposit is non-refundable.

In the event of a payment dispute, KB&CO may provide relevant transaction documentation to the applicable payment processor or financial institution, including this Agreement, order records, invoices, communications, CAD renderings, records showing delivery of the CAD, approvals, production records, shipping information, and other relevant evidence.

Nothing in this Agreement limits lawful rights relating to genuinely unauthorized transactions or other rights that cannot legally be waived.

19. Relationship to Other KB&CO Policies

This Agreement should be read together with the KB&CO:

Where this Agreement specifically addresses custom jewelry or CAD services, these custom-order provisions apply to that portion of the transaction to the extent permitted by applicable law.

20. Customer Acknowledgment

By purchasing the $300 Custom Jewelry Design & CAD Deposit, the customer acknowledges and agrees that:

  • The initial $300 deposit is non-refundable immediately upon payment.

  • The original $300 will be credited toward the final jewelry purchase when the customer completes the purchase within the applicable terms.

  • KB&CO will generally provide the first CAD rendering within a few business days after receiving the information necessary to begin.

  • The 30-calendar-day period begins when the first CAD rendering is delivered.

  • Reasonable minor design adjustments may be requested during the active design period.

  • The final CAD must be approved and the remaining balance must be paid in full within the 30-day period.

  • Failure to respond does not pause the 30-day period.

  • If the remaining balance is not paid within 30 days, the project expires.

  • The original $300 remains non-refundable after expiration.

  • Continuing an expired project requires payment of an additional $300 non-refundable CAD/reactivation fee.

  • Pricing and stone availability may change if a project expires.

  • CAD renderings are representations and may differ somewhat from the finished physical jewelry.

  • Final CAD approval authorizes KB&CO to proceed according to the approved specifications after payment requirements are satisfied.

  • Custom and made-to-order jewelry is final sale, subject to applicable law.

  • The customer has reviewed and agreed to this Agreement before purchasing the CAD deposit.
