Welcome to KB&CO. These Terms of Service ("Terms") govern your access to and use of the KB&CO website, products, custom design services, and related services.
By visiting our website, submitting an order, paying a deposit or invoice, approving a design, or purchasing a product from KB&CO, you agree to these Terms.
Please read them carefully before placing an order.
1. General Terms
KB&CO provides fine jewelry, custom jewelry, diamonds, gemstones, grillz, engagement rings, wedding jewelry, pendants, chains, and related products and services.
We reserve the right to refuse or cancel service or an order when reasonably necessary, including suspected fraud, payment issues, pricing or inventory errors, abusive conduct, or inability to fulfill an order.
You may not use our products, website, or services for any unlawful purpose.
2. Product Information
We make reasonable efforts to accurately display and describe our jewelry, diamonds, gemstones, metals, measurements, weights, colors, and other product characteristics.
Because jewelry is photographed and viewed under different lighting conditions, cameras, screens, magnification levels, and environments, the physical appearance of a product may differ slightly from photographs, videos, CAD renderings, or other digital representations.
Measurements, weights, carat weights, dimensions, and similar specifications may also contain reasonable manufacturing tolerances unless expressly guaranteed in writing.
3. Custom & Made-to-Order Jewelry
Custom jewelry includes any product designed, manufactured, sourced, personalized, engraved, sized, modified, or otherwise produced specifically for a customer.
Custom orders may involve multiple stages, including consultation, stone sourcing, deposits, CAD design, revisions, customer approval, casting, manufacturing, setting, polishing, quality control, and shipping.
Once KB&CO begins work or commits funds, materials, stones, labor, or production capacity toward a custom order, applicable deposits and payments become non-refundable as described in our Return & Refund Policy.
Custom and made-to-order merchandise is final sale except where otherwise required by applicable law.
4. CAD Designs & Customer Approval
CAD images and digital renderings are representations of the proposed design and may not perfectly reproduce the appearance of the finished physical jewelry.
Customers are responsible for carefully reviewing designs before approval, including:

Names, letters, numbers, symbols, and spelling

Ring or jewelry size

Dimensions and proportions

Engraving

Other requested customization
Once a customer approves a CAD, rendering, design, stone selection, sizing, or other specification, KB&CO is authorized to proceed with production based upon that approval.
Changes requested after approval may result in additional design, material, labor, or production charges and may extend the estimated completion date.
5. Custom Design Fees & Deposits
Certain custom projects may require an initial design, consultation, CAD, sourcing, or production deposit.
Unless otherwise stated in writing, deposits become non-refundable once KB&CO begins design work, sourcing, purchasing materials, reserving stones, or production.
Any remaining balance must be paid according to the terms provided on the customer's invoice or order.
KB&CO may pause production or withhold shipment until all outstanding amounts have been paid.
6. Customer-Provided Information
Customers are responsible for providing accurate information, including sizing, spelling, personalization, shipping information, contact information, design instructions, and other specifications.
KB&CO is not responsible for errors in a finished product resulting from incorrect information supplied or approved by the customer.
Corrections or modifications requested after production begins may incur additional charges.
7. Diamonds & Gemstones
KB&CO may sell or source natural diamonds, laboratory-grown diamonds, gemstones, and other jewelry materials.
Individual stones may naturally or visually differ from photographs or videos.
Where an independent grading report or certification accompanies a stone, the applicable laboratory's report governs the characteristics graded by that laboratory.
KB&CO does not control or independently guarantee the grading standards, opinions, or determinations of third-party grading laboratories.
8. Pricing & Payment
Prices may change without notice.
KB&CO reserves the right to correct typographical errors, inaccurate pricing, incorrect product information, inventory errors, promotional errors, or other mistakes.
If an obvious pricing or listing error affects an order, KB&CO may contact the customer to correct the order or cancel and refund the affected transaction where appropriate.
Orders are not considered fully paid until payment has successfully cleared.
9. Production Timelines
Any production or completion date provided for custom jewelry is an estimate unless expressly guaranteed in writing.
Custom manufacturing may be affected by design revisions, stone sourcing, casting, setting, material availability, quality-control requirements, shipping delays, holidays, or circumstances outside KB&CO's reasonable control.
We will make reasonable efforts to complete orders within estimated timelines but cannot guarantee an estimated completion date unless specifically agreed to in writing.
10. Shipping & Delivery
Customers are responsible for providing an accurate and secure delivery address.
High-value shipments may require insurance, tracking, signature confirmation, identification, or other verification.
Once an order is shipped, carrier delays and other circumstances outside KB&CO's reasonable control may affect delivery.
Customers must promptly notify KB&CO if a shipment appears damaged, missing, or otherwise compromised so that any available carrier or insurance claim can be investigated.
11. Inspection After Delivery
Customers should inspect their jewelry immediately after receiving it.
Claims involving an incorrect item, shipping damage, or an alleged manufacturing defect should be reported to KB&CO within 48 hours of confirmed delivery, where reasonably possible.
Customers should not wear, alter, resize, repair, or permit another jeweler to work on an item that is the subject of a claim before KB&CO has had an opportunity to evaluate the issue.
12. Returns & Refunds
Returns, refunds, cancellations, exchanges, and final-sale merchandise are governed by our Return & Refund Policy, which is incorporated into these Terms.
Custom, personalized, engraved, specially sized, made-to-order, and specially sourced merchandise is generally final sale.
13. Repairs, Maintenance & Normal Wear
Fine jewelry requires appropriate care and maintenance.
Scratches, wear to metal finishes, bent or damaged prongs, broken chains, stone loss resulting from impact or damage, discoloration caused by chemicals or environmental exposure, and similar conditions resulting from ordinary wear, accidents, misuse, or improper care are not automatically considered manufacturing defects.
Having another jeweler alter, resize, repair, modify, or otherwise work on a KB&CO piece may affect KB&CO's ability to determine the cause of a subsequent issue.
14. Fraud Prevention
KB&CO reserves the right to use reasonable fraud-prevention measures for transactions, particularly high-value purchases.
We may request additional verification before processing or shipping an order.
Orders may be delayed, refused, or cancelled if we cannot reasonably verify a transaction or believe a transaction may be unauthorized or fraudulent.
15. Chargebacks & Payment Disputes
Customers agree to contact KB&CO regarding an order concern so that we have an opportunity to address the matter.
A chargeback or payment dispute does not independently create a right to a refund or cancel contractual obligations associated with a valid custom or completed order.
When responding to a payment dispute, KB&CO may provide the applicable payment processor or financial institution with relevant transaction documentation, including invoices, communications, customer approvals, CAD approvals, photographs, shipping records, tracking information, delivery confirmation, and the Terms and policies accepted in connection with the transaction.
Nothing in this section limits a customer's lawful rights to dispute genuinely unauthorized transactions or exercise rights that cannot legally be waived.
16. Intellectual Property & Custom Designs
Unless otherwise agreed in writing, KB&CO retains its rights in original CAD files, renderings, photographs, videos, graphics, website content, branding, and original design materials created by or for KB&CO.
Purchasing a finished piece does not automatically transfer intellectual-property rights in KB&CO's underlying CAD files, manufacturing files, photographs, renderings, or design materials.
Customers represent that they have the necessary rights or permission to provide any logos, artwork, photographs, names, trademarks, or other materials submitted to KB&CO for incorporation into a custom design.
17. Photography & Marketing
KB&CO may photograph or record jewelry that we create for portfolio, social-media, advertising, educational, or promotional purposes unless otherwise agreed with the customer.
We will make reasonable efforts not to publicly disclose private customer information in connection with such content.
Customers seeking confidentiality for a particular custom project should notify KB&CO before production.
18. Third-Party Services
Our website may use services provided by third parties, including Shopify, payment processors, shipping carriers, financing providers, analytics providers, and other technology platforms.
KB&CO is not responsible for outages, interruptions, policies, or actions of third-party providers outside our reasonable control.
Use of certain third-party services may also be governed by that provider's own terms.
19. Prohibited Use
Customers may not use the KB&CO website or services to engage in fraud, submit unauthorized payment information, interfere with website security, introduce malicious software, scrape or reproduce protected content unlawfully, impersonate another person, or otherwise violate applicable law.
20. Limitation of Liability
To the fullest extent permitted by applicable law, KB&CO will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website, products, or services.
To the fullest extent permitted by law, KB&CO's aggregate liability relating to a particular purchase will not exceed the amount actually paid to KB&CO for the product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold KB&CO and its owners, employees, contractors, and affiliates harmless from third-party claims arising from your unlawful use of our website or services, your violation of these Terms, or materials you provide to us in violation of another party's rights.
22. Governing Law
These Terms and transactions with KB&CO will be governed by the laws of the jurisdiction in which KB&CO's contracting business entity is established, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
23. Changes to These Terms
KB&CO may update these Terms periodically.
The version applicable to an order will generally be the version presented or in effect when the applicable transaction or agreement was entered into, subject to changes required by law.
24. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
25. Entire Agreement
These Terms, together with the applicable order, invoice, Return & Refund Policy, Shipping Policy, Privacy Policy, and any written custom-order terms provided by KB&CO, constitute the agreement governing the applicable transaction unless otherwise agreed in writing.
